1.
Extra Benefits provides a secure website facility
for the purchase of retailer issued eGift cards and eMovie tickets (eGift Cards) giving access to certain
discounts and special offers on selected goods or services.
2.
Extra Benefits is a service supplied by ALI
Group Pty Ltd ABN 42 101 330 036 (we,
us, our).
3.
By using Extra Benefits you acknowledge that you
have read and agree to be bound by these Terms and Conditions.
4.
You can use Extra Benefits to purchase eGift
Cards from retailers who participate in Extra Benefits (Retailers).
5.
We may modify these Terms and Conditions in
accordance with clause 28.
We recommend that you regularly review these Terms and Conditions on the Extra
Benefits website to ensure you are aware of any changes. Your continued use of Extra
Benefits will constitute acceptance of these Terms and Conditions.
Eligibility and access
6. To
be eligible for Extra Benefits you must:
a.
own a current policy distributed by or under the
authority of Australian Life Insurance Distribution Pty Ltd ABN 31 103 157 811
AFSL 226403 (ALID); or
b.
hold current authorisation (as defined in
section 916A of the Corporations Act 2001 (Commonwealth)) from ALID; or
c.
be deemed eligible at our discretion.
7.
To access Extra Benefits you must have a valid
Australian mobile phone number and email address. We will use the mobile phone
number and email address associated with your ALID policy or your authorisation
from ALID.
8.
Multi-factor authentication is mandatory each time
you log in to Extra Benefits. You will be prompted to receive either an SMS or
email authentication (or in some instances both) upon each log in.
Purchasing eGift Cards
9.
You can purchase eGift Cards by following the
instructions on the Extra Benefits website after logging in, using your VISA or
MasterCard credit or debit card. We impose a $2,500 daily limit on eGift Card
purchases.
10.
We will confirm your purchase by email when we
receive your payment. These emails, and your bank statement, will refer to our
payment gateway provider The Ambassador Card Pty Ltd as your payee. You agree
not to pursue charge backs in relation to payments you have authorised to The
Ambassador Card. If you do pursue a charge back only because you do not
recognise The Ambassador Card we will ask you to reverse the charge back, or
otherwise compensate us and you must do so within 7 days.
IMPORTANT Your payment receipt and bank statement will name The Ambassador Card as the payee for your purchase. You should not dispute or charge back a transaction simply because The Ambassador Card is the payee. We
impose a daily limit on the purchase of eGift Cards to reduce the risk of
scam or fraud losses. If anyone asks you to pay for anything using eGift
Cards you should assume that it is a scam attempt. |
Delivery of eGift Cards
11.
We deliver eGift Cards purchased through Extra
Benefits to the last email address you have given us. You are responsible for
ensuring that your email address remains current.
12.
We normally supply eGift Cards almost
immediately. However, you must allow up to 48 hours for delivery of your eGift
Card purchases.
Responsibility for eGift
Cards
13.
When you purchase eGift Cards through Extra
Benefits, the purchase is subject to the Retailer’s terms and conditions,
including the expiration date of the eGift Card. You acknowledge that Retailers
may impose limits and conditions such as:
a.
the number of cards available to purchase during
a specified period (for example, limiting the number or value of cards you can
purchase each day); or
b.
the number of cards you can use toward a
specific purchase (for example, an online travel provider might limit the
number of cards you can use toward a flight).
14.
You agree that other than supplying you with eGift
Cards in fulfillment of your purchases, we are not responsible for the
Retailer’s obligations to you.
Information on our website and Retailer terms and
conditions
15.
We will take reasonable steps to ensure that all
information on the Extra Benefits website is accurate. However, we do not warrant that the information on
our site is complete. We provide links to Retailer websites so that you can
access each Retailer’s terms and conditions and ascertain whether limits or
restrictions on your use of eGift Cards may apply, and other important
information about your use of eGift Cards.
Prices and discounts
16.
eGift Card prices shown on the Extra Benefits
website are in Australian dollars (AUD) and include the Goods and Services Tax (GST).
We calculate discounts shown on our website as the difference between the eGift
Card price and the monetary value of the eGift Card as a percentage of the eGift
Card price. For example, if you buy a $100 eGift Card for a price of $95, your
discount is 5%.
17.
We reserve the right to change any prices and
any discounts shown on the Extra Benefits website at any time.
eGift Card winnings
18.
If you participate in competitions or offers
that consist of eGift Card entitlements as prizes, we may credit your Extra
Benefits with a corresponding amount of eGift Card entitlements denominated in
Australian dollars. These entitlements:
a.
may be used to acquire eGift Cards, but are not available
for cash withdrawal and;
b.
remain available until spent or until your
access to Extra Benefits ends in accordance with clause 29.
Payments, refunds and validity
19.
You warrant and agree that, in purchasing eGift Cards:
a.
the credit or debit card used is your own;
b.
you consent to all validation checks and
authorisation by your credit or debit card issuer and the Retailer; and
c.
if the issuer of your credit card refuses to
authorise payment for eGift Cards from Retailers, we will not be liable for any
delay or non-delivery of an eGift Card.
20.
Unless an eGift Card is invalid or defective, purchased eGift Cards are not refundable
and cannot be exchanged for other eGift Cards.
21.
eGift Cards are valid from the date of purchase
until the expiry date specified on the eGift Card or in the Retailer’s terms
and conditions.
Rules and restrictions
22.
You must not:
a.
engage in any fraudulent or misleading conduct
in relation to Extra Benefits or eGift Cards supplied through Extra Benefits;
b.
re-sell eGift Cards;
c.
purchase eGift Cards for the purpose of a
commercial or business activity;
d.
infringe on any intellectual property rights or
other rights; or
e.
use or access the Extra Benefits website to
interfere with the security of the website.
Communicating with you
23.
By activating Extra Benefits, you agree that:
a.
any information you provide us may be used by
ALI for marketing, planning, product development, research and other commercial
purposes;
b.
you may receive digital communications which
include latest benefits and recommendations on ways to maximise the Extra
Benefits program benefits, unless you have selected to opt-out of direct
marketing;
c.
if you wish to change your marketing
preferences, you may do so by contacting us at [email protected] or by
using our unsubscribe facility;
d.
opting out of Extra Benefits communications will
also opt you out of receiving ALI marketing communications; and
e.
opting out of Extra Benefits or other ALI
marketing communications or cancelling your membership of the Program will not
affect:
(i)
your receipt of service-related information
including payment and renewal reminders and policy information from ALI;
(ii)
your policy or authorisation (as applicable); or
(iii) communications
in relation to your relationship with us that are not commercial electronic
messages within the meaning of the Spam Act 2003 (Commonwealth).
Unauthorised transactions
24.
You must notify us immediately of any
unauthorised eGift Card purchases or any compromise to your Extra Benefits credentials.
For example, if your mobile telephone is taken and might be used without your
authority.
25.
We may suspend your access to Extra Benefits if
we reasonably suspect that your Extra Benefits has been subject to suspicious
activity. We will take reasonable steps to notify you promptly if this happens.
26.
If we suspend your access, or if you tell us
that you have experienced an unauthorised transaction or your credentials have
been compromised, we will refund any unauthorised purchases made after the
suspension, or after you told us.
27.
Where clause 26
does not apply, unless circumstances arise where it is unreasonable for us to
do so, we may rely on the use of your credentials and we will not be liable to
you for any unauthorised eGift Card purchase.
Changes to Extra Benefits
28. We may change these Terms and Conditions on reasonable notice. We do not need to give you advance notice of changes that benefit you, changes to Retailers (for example, new Retailers joining the Program or Retailers leaving the program) or changes to the price of any eGift Card. We will give 30 days’ prior notice of changes that introduce charges or fees, or which may adversely affect unspent eGift Card entitlements. Any changes we make to the Extra Benefits website take effect immediately unless otherwise stated, but will not apply to any transactions you made and paid for prior to the change.
Termination of Extra Benefits
29.
We reserve the right to terminate your access to
Extra Benefits at any time in accordance with this clause:
Closure
a.
We may close Extra Benefits in its entirety on 30
days’ notice. We will honour all purchases made before the last day of the
notice period;
Ineligibility
b.
If you cease to meet the eligibility
requirements in clause 6,
your access to Extra Benefits will cease within 30 days. We will give you 30 days’
notice before you lose access to Extra Benefits. We are not liable if you fail
to save any eGift Card sent to your email before your Extra Benefits becomes
inactive, or to apply any eGift card entitlements to the purchase of eGift
Cards; and
Breach of these
Terms and Conditions
c.
If you breach these Terms and Conditions we may
terminate your access to Extra Benefits immediately. We will notify you
promptly if we do so. We may set off unused eGift Card entitlements against any
loss we have incurred because of your breach. To the extent that you have any
remaining eGift Card entitlements, we will pay you the monetary value of those
entitlements.
Links to other sites
30.
These Terms and Conditions apply to the Extra
Benefits website and your use of Extra Benefits. These Terms and Conditions do
not apply to Retailer or other third party websites to which we provide links
within the Extra Benefits website.
31.
Retailer sites linked to Extra Benefits are
developed by third parties that we do not control. We do not warrant that information
on those sites is correct or complete.
Liability
32.
You acknowledge and agree that:
a.
we take reasonable steps to ensure that Extra
Benefits remains available and that all eGift Cards can be purchased by all
promoted Retailers. However, from time-to-time Extra Benefits and Retailers may
experience outages. You agree that we are not liable to you as a result of service
discontinuity;
b.
nothing in these Terms
and Conditions will, or is intended to, disclaim, exclude, prevent or limit the
application of the Australian Consumer Law set out in Schedule 2 to the
Competition and Consumer Act 2010 (Commonwealth). However:
(i)
in accordance with
the Australian Consumer Law, our liability to you in relation to eGift Cards is
limited to the cost of replacing or re-providing any eGift Card that is
defective, not delivered or otherwise fails to meet the standards or
requirements of the Australian Consumer Law; and
(ii)
you may not recover from
us any damage or loss of in the nature of missed opportunity, indirect or
consequential loss.
Disclaimer and Legal Notice
33.
Your use of the Extra Benefits website and these
Terms and Conditions is governed by the laws of New South Wales and you submit
to the non-exclusive jurisdiction of the courts exercising jurisdiction there.
Privacy Policy
34.
Our Privacy Policy can be found here and sets out
what information we collect from you and how we will use your information. We
may, acting reasonably, change the Privacy Policy and are not required to give
you notice of any change.

35.
All content on the Extra Benefits website is
copyright and is either our property or is used under licence or authorisation
and is protected by Australian and international copyright laws (unless
previously public domain). This includes text, images, colours and all aspects
of visual design. You must not reproduce or distribute any such content for any
infringing purpose without our written consent.
